Disability Resource Services

A recently enacted exception in the U.S. copyright law makes providing electronic textbooks saved to computerized disc possible under the law in the United States, as long as the copyrighted books are only available to people with bona fide disabilities.

Access to copyrighted works for the general public is not allowed.

Legal Requirements

Disability Resource Services online library access allows users with print disabilities to legally access specialized formatted textbooks. UW-L’s Disability Resource Services in conjunction with Murphy Library includes the necessary controls to protect against use by non-disabled persons by the use of a password protected site. Disability Resource Services meets the requirements of the relevant section of copyright law, 17 U.S.C. § 121:

"... it is not an infringement of copyright for an authorized entity to reproduce or to distribute copies of a previously published, nondramatic literary work if such copies are reproduced or distributed in specialized formats exclusively for use by blind or other persons with disabilities."

Copies may not be reproduced or distributed in a format other than a specialized format exclusively for use by blind or other persons with disabilities.
Must bear a notice that any further reproduction or distribution in a format other than a specialized format is an infringement.
Must include a copyright notice identifying the copyright owner and the date of the original publication.
"Specialized formats" means Braille, tapes, electronic text which is exclusively intended for use by blind or other persons with disabilities.
The textbook has been purchased either by the university or the student prior to authorization to the material in alternative format.

UW-L is a nonprofit organization and meets the definition of an “authorized entity”.

In addition, some publishers and authors have provided permission for books and other publications they provide in digital form to be made available in accessible digital formats to individuals with qualifying disabilities.

The DRS Digital Rights Management Plan

UW-L’s Disability Resource Services in conjunction with Murphy Library makes active efforts to ensure that its collection and its users abide by the law to maximize the benefits realized by the students and minimize abuse. Disability Resource Services controls the format of the materials that it provides and ensures the appropriate copyright notices are in its digital publications. Access is restricted to disabled individuals and other authorized entities. Through a password protected site Murphy Library helps to ensure that access remains limited to those covered by the copyright law exemption.

1. Qualified Users

Only blind or other persons with disabilities that affect their ability to access print are permitted to download copyrighted textbooks. A user must be register with the Disability Resource Services and have on file documentation that a certified recognized expert can attest to the physical basis that limits the student’s use of standard print.

2. Contractual Agreement

All UW-L Disability Resource Services students have a signed agreement on file to agree to terms of use that forbid violation of the copyright law restrictions on redistribution and use of copyrighted material while they are registered with the Disability Resource Services office. Students will be required to delete any and all material they downloaded from the password protected site at the end of each semester. Students who violate these terms will lose their access to e-textbooks and may suffer other legal consequences as a result of their actions. See Fig. 1.

3. Copyright Notice

In order to comply with the copyright law regulating the provision of accessible books to people with disabilities (17 U.S.C. § 121), Disability Resource Services ensures that all copyrighted materials bear a notice that any further reproduction or distribution in a format other than a specialized format is an infringement. Such content includes a copyright notice identifying the copyright owner and the date of the original publication. See Fig. 2.

4. Password Protected

All copyrighted electronic text material on file with Murphy Library is password protected as part of the protection process to maintain the integrity that only students on file with the Disability Resource Services are able to use this service.

5. Security of Authorization

A list of students who are given permission and granted access to Murphy Library electronic text material using a password, are on file with the Disability Resource Services Accommodations Managers data base and updated each semester. To protect the security of authorization, the password is changed each semester.

The text files are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subdivision (c) (1) (ii) of the Rights in Technical Data and Computer Software clause at DFARS 25.277.7013 for DoD contracts, paragraphs (c) (1) and (2) of the Commercial Computer Software-Restricted Rights clause in the FAR (48 CFR 52.227-19) for civilian agencies, or in other comparable agency clauses.

File Types These extensions at the end of a filename refer to the type of file it is. This information is used by your operating system to launch an appropriate program when you click on the filename. Example: file.txt is a text file and can be opened by a text editor program.

.GLY	Glossary	.TAR	Tar - Tape ARchive (filename extension). Tar is a UNIX method of archiving files, which can also be used by PCs. Tar archives files but does not compress them, so sometimes .tar files are compressed with other utilities, which produces extensions like .tar.gz, .tar.Z, and .tgz. Archive files with the .tar extension can be extracted in UNIX with tar or on a PC with WinZip or on the Mac with the program Tar.
