Leave of Absence Without Pay (LWOP) Policy - Unclassified
A leave of absence without pay may be granted when the leave is mutually beneficial to both the employee and the department/unit. Leave of absences must be requested in advance. Leave requests for up to two weeks may be granted by the immediate supervisor and dean/division officer.
Unclassified Leave of Absence Without Pay Policy
The Leave of Absence Without Pay policy is for leaves not covered under The Family Medical Leave Policy (FMLA/WFMLA), Funeral Leave, Sick Leave, Military Leave or Annual (Vacation/Personal Holiday) Leave.
For purposes of this policy, a leave of absence without pay is temporary separation of faculty or academic staff member from the University, with the expectation that they will return.
A leave of absence may be granted for a maximum of one year. Leaves that extent beyond one year, are subject Regent Resolution and Board of Regent approval.
Procedure for Leave – Up to 1 Year
A request for a leave of absence without pay of one year or less is initiated by writing a formal letter requesting the leave of absence without pay.
Leave of absences must be requested in advance. Leave requests for up to two weeks may be granted by the immediate supervisor and dean/division officer.
A written request is submitted to the supervisor/department chair and dean/division officer and requires the affirmative recommendation of the Provost and the approval of the Chancellor. (The needs and the function of the unit/department is reviewed then making the decision to approve the leave.)
Upon approved by the Chancellor, documentation is forwarded to Human Resources for recording, processing and filling in the employee’s file.
Extend Leave- 1 Additional Year
The leave may be extended up to one (1) additional year. An extension requires a written request and requires the affirmative recommendation of the department, the dean, and the Provost with the final approval of the Chancellor.
An extension approved by the Chancellor beyond one year is contingent upon the staff member returning a signed agreement acknowledging that failure to return at the conclusion of the approved leave period constitutes a resignation (as stated in Regent Resolution #5364).
Extend Leave- Beyond 2 Years
An extension of a leave of absence beyond the second year must be recommended by the Chancellor and approved by the Board of Regents. Only under unusual circumstances will an extension be forwarded to the Board of Regents it may not be open ended, but must be for a fixed period of time (Regent Resolution #5364).
