PLEASE READ THIS IMPORTANT MESSAGE BEFORE PLANNING YOUR ADVERTISING STRATEGY FOR OPEN FACULTY POSITIONS:
There is a requirement of the U.S. Department of Labor
(DOL) that could have an impact on your hiring of faculty, if your new faculty
member is a foreign national (this is a term for a person who is not a U.S.
citizen and is not a permanent resident of the U.S.). As part of the DOLs
permanent labor certification process (this leads toward permanent resident
status) DOL reviews our recruitment process and the qualifications of the person
hired relative to the advertised duties and qualifications. DOL requires PRINT
advertising for the position that states the title, duties, and the qualifications for
the position, and is placed in a national professional journal.
This has not been a problem in the past for UW-L since some form of print advertising that met the DOL requirement was routinely part of advertising. However, it could become an issue if you hire a foreign national and cannot meet DOLs requirement. Until DOL changes its regulations or practice, you may want to consider ensuring you have a national print ad in a national professional journal that lists the title, duties and qualifications for your faculty recruitments. You may find that you have a national journal that will effectively reach your intended audience, meets DOL requirement, and is cost-effective. Not having a national print advertisement cannot be a factor in your selection of the most qualified candidateyou cannot discriminate against a foreign national because of the DOL/immigration process.
